WP119 Auto Repair Station β€” Terms of Service

0. Preamble

Welcome to WP119 Auto Repair Station ("the Service"), provided by Yi Gong Yan Chuang Co., Ltd. ("the Company").

To protect your rights, please read these Terms carefully before use. The full text of these Terms is published on the Service's website from the date of announcement; you may read and download it at any time before use, and decide for yourself how much time you need to review it. Once you press the agree button or begin using the Service, you are deemed to have read, understood and agreed to all of these Terms.

You must be a natural person with full legal capacity, or a lawfully registered legal entity or organization, in order to use the Service. "You" below refers to the user of the Service.

Please pay particular attention to Article 9 (Fees, Payment Deadlines and Refunds) and Article 10 (Limitation of Liability); these two articles will have a real effect on your rights.

1. Formation of the contract

These Terms, the Connection and Service Scope Consent Form, the Repair Authorization Consent Form, together with the process, explanations, prices and notes set out on the Service's website, constitute the entire agreement between you and the Company.

Where there is doubt as to the interpretation of these Terms, they shall be interpreted in favor of the consumer. Both parties agree that electronic documents may be used as the means of expression.

Each act by which you agree to a document is recorded and retained as "text version + content hash + timestamp + source IP + ticked items". The version you agreed to applies to the whole of that case of yours, and is retained by the Company and available for retrieval and comparison.

2. Content and scope of the Service

The Service is an automated fault diagnosis and repair service for WordPress websites, carried out by the system automatically from beginning to end.

The purpose of the Service is to return a faulty website to normal operation. To that end, the system may disable the plugin or theme causing the fault, move out the program files causing the fault, and adjust site and server settings. The Service does not repair, and does not guarantee, the functionality or integrity of any plugin, theme, custom code, product data or content data.

The following are outside the scope of the Service: SEO, content writing, website design, host migration, version upgrades, performance tuning, and problems with the media files (images, uploads) themselves.

The manner and scope of the Service are as published on the Company's website at the time the Service is provided.

3. Service territory, currency and governing law

(1) Taiwan is the principal market for the Service; the English and Japanese pages make the Service available to users outside Taiwan. The Company may use technical means (for example origin-region detection or card-issuing-region restrictions on payment methods) to restrict access and transactions from particular countries or regions, and may decline to provide the Service in particular countries or regions as required by law or by Company policy.

(2) Pricing and collection for the Service are in the currency and amount shown on the transaction page at checkout. The applicable currency and payment provider are determined by the Company according to the page language you use, and are disclosed to you before payment.

(3) For transactions collected in New Taiwan Dollars, a uniform invoice is issued under the laws of the Republic of China; for transactions collected in other currencies, the receipt provided by the payment provider serves as the record, and invoicing and tax are handled under the applicable laws.

(4) The Service is provided under the laws of the Republic of China. If you use the Service from outside Taiwan, you understand and agree that the Service has not been adapted to the laws of your region and that you are using it at your own initiative.

(5) The Company reserves the right to refuse or terminate a case where it considers this necessary, and will refund in full the fees you have paid.

(6) Where an order is processed through Paddle.com, Paddle.com acts as the Company's online reseller and is the Merchant of Record for that order. Paddle handles payment, any applicable sales taxes, and inquiries and refunds relating to that order.

4. Collection, processing and use of personal data

Pursuant to Article 8 of the Personal Data Protection Act, you are notified of the following.

I. Collector: Yi Gong Yan Chuang Co., Ltd.

II. Purposes: providing website fault diagnosis and repair, producing and delivering reports, case notifications, performance of the contract, refund handling, evidence for disputes and the exercise or defense of legal claims, service security and fraud prevention.

(3) Categories of personal data collected: what you provide yourself is your e-mail address (which must be verified) and your website address, and depending on the mode you choose may include host connection details, as well as the content of any e-mail you send to the Service's customer-support mailbox; what the system obtains automatically is your IP address, browser information and operation timestamps; what is touched in the course of diagnosis and repair is your website's program files and the database contents within the scope defined in Article 5. Payment data does not pass through the Company's systems: card numbers and the like are handled directly by the third-party payment provider used by the Company at the time, on that provider's own checkout page.

(4) Case communication channel: the Service requires you to verify an e-mail address. Important notices for a case β€” the health check report, the repair report, the location of the pre-repair backup, and the Data Access Certificate β€” are all sent to that address, and it is for you to keep them.

V. Period of use: until the retention periods set out in Article 8 expire.

(6) Territory of use: within the Republic of China, and the territories where the servers of the processors listed in Article 6 are located.

VII. Recipients and manner of use: the Company and the processors listed in Article 6, in electronic form, within the purposes stated in item II.

VIII. What the Company will never do: use your data or your website users' data for marketing, sell it, exchange it, provide it to third parties unrelated to the Service, or use it to train any AI model.

IX. Your rights: under Article 3 of the Personal Data Protection Act you may, regarding your personal data held by the Company, request access, review, a copy, supplementation or correction, cessation of collection, processing or use, and deletion. To exercise them, write to support@wp119.com; the Company will reply within three business days.

X. Consequence of not providing data: you may decline to provide the data above, but every step of the Service depends on it, so without it the Service cannot be used.

5. Your website users' data does not enter the repair station

This is the main difference between the Service and ordinary website-repair services; please understand its scope and its limits.

(1) Tables from which only the structure, not the contents, is taken: when the Service obtains your website data, apart from the core content tables such as posts, pages, categories, site settings and URL rules, every other table has only its structure taken and not its contents. Those designated "protected tables" cover the tables that store the following: your website's user accounts and member data, comments, orders and transaction records, form submissions, newsletter subscriber lists, login and security logs, and visitor statistics. Orders and form submissions stored inside the posts table are likewise excluded row by row. The actual extent of the protected tables depends on the plugins installed on your website and changes as the Service is updated; the actual scope taken for each case is as stated in that case's Data Access Certificate.

(2) In-place execution: if a repair needs to change a protected table (for example clearing spam comments or correcting comment URLs), that action is carried out in place on your own host, and its contents do not enter the repair station. In-place work is done in batches and your website continues to operate during it; the items actually carried out are listed one by one in the repair report.

(3) Blocking at write-back: when the repair result is written back to your website, the system runs a blocking check on the protected tables. If the contents of a protected table appear in what is being written back, the system stops the write-back and your website is not changed.

IV. Media files: in all three modes, media files (images and uploads) stay on your original host and are not copied to the repair station.

(5) Data Access Certificate: for any case in which the repair station obtained data from your website, the Service attaches a "Data Access Certificate" when it sends that case's repair report or case-closure notice to your verified e-mail address. The certificate states, as conclusions: whether the contents of protected tables entered the repair station; the categories of tables whose contents entered the repair station and of those for which only the structure was obtained; the version and time of each document you agreed to; and the times at which the repair station and the host credentials were destroyed. Where any of these has not yet happened at the time of sending, cannot be confirmed, or does not apply to the case, the certificate says so.

(6) The boundary of this Article β€” please be sure to understand: what this Article protects is the protected tables described above. The repair station still obtains your website's content tables such as posts, pages, categories and settings, as well as its program files. Those contents may include personal data of your own (for example an administrator e-mail address, or contact details you have posted yourself in a post or page). The Company therefore does not claim that "no personal data is obtained", but that "the contents of protected tables are not obtained".

(7) Scope of application: the mechanism described in this Article applies to cases accepted after these Terms take effect.

6. The processing relationship and the processors

(1) Legal position: as regards third parties' personal data contained in your website, you are the collecting party for that personal data and the Company is a processor commissioned by you. Under Article 4 of the Personal Data Protection Act, the Company is treated as the commissioning body within the commissioned scope, and processes the data solely for the purposes set out in these Terms and on your instructions, and may not go beyond them.

II. Your obligations: you represent and warrant that, for the third-party personal data contained in your website, you have given the notices and obtained the consents required by law, and are entitled to engage the Company for the processing described in these terms.

(3) Processors: the host and computing provider for the Service (including the Service's website, case records and the repair station; servers located outside the Republic of China), the provider of encrypted transmission and security protection for website connections, the third-party payment provider(s) used by the Company at the time (which may differ by currency or page language, and may be more than one), the e-mail delivery provider, and the customer-support mailbox provider. The name and location of each processor are published on the processors information page of the Service's website. For orders processed through Paddle.com, Paddle.com is the Merchant of Record under Article 3(6) and a recipient of your data for the purposes of this Article.

(4) Notice of international transfer: during processing and the retention periods set out in Article 8, your personal data and website data may be transferred to a region outside the Republic of China and processed or stored there. You consent to this transfer.

V. Change of processors: the Company may replace a processor within the categories listed in paragraph 3 without obtaining your consent again; when a replacement takes effect, the name and region of the new processor are published on the processor information page referred to in paragraph 3.

7. Information security and the pre-repair backup

In these Terms, "repair station" means the cloud working environment that the Service sets up for each case alone, serving only that case and destroyed when the case ends; it is distinct from the name of the Service itself, "WP119 Auto Repair Station", which refers to the Service as a whole.

I. Case isolation: every case uses its own isolated repair station, separate from every other case and destroyed when the case ends.

(2) Sandbox work: all repair work is done on a copy, and is written back to your live site only after it passes re-verification. Before you agree to the Repair Authorization Consent Form, the Company makes no change whatsoever to your live site.

(3) Pre-repair backup: before the repair result is written back to your live site, the system creates a complete compressed backup (files and database) on your own host and notifies you of its location by e-mail. For users of WP-admin mode, the backup plugin produces the original compressed archive of your site at the same time as it builds the repair package, and asks you to download and keep it. That backup sits under your control, is not encrypted, and can be downloaded and restored by you. The Company will not delete it; please do not delete it yourself until you have confirmed that your website is working normally again.

(4) Protection of credentials: the host credentials you provide are encrypted and sealed the moment they reach the Company's systems, are unsealed only at the moment of an actual connection, and are destroyed at the end of the case with a destruction record produced.

(5) Please change your credentials after the case ends: as standard information-security practice, we strongly recommend that you change your host credentials immediately after the case ends. Although the Company has destroyed the copy it held, the continuing responsibility for managing those credentials remains yours.

(6) Each party's own security responsibility: the Company and you shall each ensure the security of their own information systems.

(7) Notification of a personal data incident: if a personal data incident occurs that affects your data, the Company will notify you within 72 hours of becoming aware of it, explaining the extent of the impact, the measures already taken and the action we suggest you take, and will report it to the competent authority as required by law. If the incident affects the personal data of your website's users, you are the collecting party under the Personal Data Protection Act and the duty to notify those individuals is yours to discharge; the Company will provide the necessary assistance.

(8) Security maintenance plan: the Company has established a security maintenance plan for personal data files and reviews its implementation regularly.

8. Retention and destruction

(1) Your website data: not retained. The data obtained is held in an isolated repair station dedicated to the case, and that repair station is destroyed automatically once the case ends. If you use WP admin mode, the repair package you upload (before the repair station is created) and the repaired package (during its download window) are held temporarily on the Service's control system and are destroyed when the window expires or the case ends.

(2) Host credentials: destroyed at the end of the case, with a destruction record produced.

(3) Service history records: in order to honor the refund undertakings, handle disputes, and exercise or defend legal claims, the Company retains service history records (the case timeline, inspection and re-verification results, the Data Access Certificate, consent records, and payment and refund records). These records do not contain the content of your website.

Technical records containing no personal data (row counts, hash values, timestamps, system events, document versions): retained permanently, as long-term evidence of the data access scope of the Service. Such records consist only of figures, hash values and event entries.

Fields containing personal data (your e-mail address, IP address, browser identification information and website address): retained for fifteen years from the end of the case, covering the expiry of the relevant limitation periods. After that period they are replaced by an irreversible salted hash, so that your personal data is no longer directly shown while the integrity and comparability of the record remain unchanged. You may still enquire with the Company about your case records using the original e-mail address.

System logs: up to five years from the date they are produced. Where the law requires retention, the statutory period applies.

Customer-support correspondence: e-mails you send to the Service's customer-support mailbox and the Company's replies are retained for fifteen years from the end of the case (or, where there is no corresponding case, from receipt of the e-mail) and deleted when that period expires.

(4) Early deletion: after a case ends you may ask for your case records to be deleted early, except for records the law requires to be kept and the service history records described in the preceding paragraph that are necessary for exercising or defending legal claims.

V. Evidential effect of the records (evidence agreement): unless there is an obvious error or you raise an objection with the Company under these terms, both parties agree that facts about the provision of the Service are determined by the service history record and its timestamps generated automatically by the Company's system; either party may rebut it with contrary evidence. You may ask the Company to provide the service history record of your case in the manner set out in paragraph 9 of Article 4; the pre-repair backup on your host may also be used for comparison.

9. Fees, payment deadlines and refunds

(1) Two-stage charging: the Service is charged in two stages β€” the health check fee and the repair fee. The amount for each stage is clearly disclosed on the transaction page before you pay, with a confirmation step so that you can check it before placing the order.

(2) Payment deadlines: the health check fee must be paid within the period shown by the system after the case is opened; if it is not, the case is canceled automatically and no fee is charged. The repair fee must be paid within the period shown by the system after the health check is complete and a quotation has been provided; if it is not, the case is closed automatically. These periods are clearly displayed on the respective payment pages.

(3) The health check is performed immediately upon payment: you expressly request and agree that the Service begins the health check as soon as payment is completed. The health check is "digital content not supplied on a tangible medium" and an "online service that is complete once supplied": once the system has completed the health check and delivered the report, that service has been fully performed and the health check fee has been earned. The same applies if you then choose not to proceed with the repair, or if the case is closed because the repair fee was not paid within the deadline. If the case is closed before the health check is completed, the health check fee is refunded in full, carried out automatically by the system with no application needed. Under Article 19 of the Consumer Protection Act and Article 2, subparagraph 5 of the Regulations on Reasonable Exceptions to the Right of Rescission for Distance Sales, a service of this kind β€” provided only with your prior consent and complete once supplied β€” is not subject to the unconditional seven-day right of rescission (withdrawal).

(4) The repair fee is performed immediately upon payment: you expressly request and agree that the Company begins the repair immediately once the repair fee is paid. The repair is an "online service that is complete once supplied" and, under the provisions set out in the preceding paragraph, is not subject to the unconditional seven-day right of rescission.

(5) Refund undertakings that go beyond what the law requires: the above are situations in which you have no unconditional right to a refund under the law in any event. Separately from that, the Company offers refund undertakings that go beyond what the law requires: where the case is of a type the Company does not accept, the health check fee is refunded in full; where the repair cannot be completed, the repair fee is refunded in full. "The repair cannot be completed" means any of the following: (i) the repair result does not pass re-verification in the repair station; (ii) the repair result cannot be written back to your website, or after write-back does not pass the Service's automatic verification β€” in WP admin mode, a repaired package that has passed re-verification cannot be delivered; (iii) the repair result has been written back or delivered, but an item listed in the repair report could not be completed, or the database operations carried out in place on your host at write-back could not all be completed β€” in that case the Company will not remove the repair result already written back to your website and will not charge separately for it. The refund is carried out automatically by the system with no application needed. These undertakings are the Company's own standard for service quality, are not compelled by law, and do not affect any other rights you have under the law.

(6) Fee adjustments: the Company may adjust the fees for the Service. Adjusted fees are published on the Service's website and apply only to cases formed thereafter.

(7) For orders processed through Paddle.com: any amount to be refunded under this Article is submitted automatically by the system to Paddle as a refund request and is returned to the original payment method once Paddle approves it. In addition, you may submit refund requests relating to that order to Paddle (paddle.net) under Paddle's refund policy (paddle.com/legal/refund-policy). This paragraph does not affect any other rights you have under the law.

10. Limitation of liability

I. Provided as is: the Service is provided according to industry standards and the system's functions and condition at the time. Except for causes attributable to the Company, the Company makes no express or implied warranty regarding your particular requirements or needs, including but not limited to repair success rate, speed, security, reliability, completeness, accuracy, or freedom from disconnection or error.

II. No guarantee of repair: the Company uses commercially reasonable efforts to restore your website to normal operation but does not guarantee that any particular problem will be fixed. Whether it can be fixed depends on the nature of the fault, which the Company discloses honestly in the quote and the report. Whether the repair is complete is determined under paragraph 5 of Article 9.

(3) Cap on liability: for direct or indirect loss you suffer from using the Service, where it is attributable to the Company and the Company is liable in damages under the law, the Company's aggregate liability to you is limited, to the maximum extent permitted by law, to the total fees actually received by the Company for that case.

IV. Excluded types of loss: neither party is liable for indirect, incidental, consequential or punitive damages, or for loss of business profit, revenue, anticipated profit or of data itself. This item applies to both parties.

V. Where the limits do not apply: the two preceding items do not apply to liability that the law does not allow to be limited or excluded (for example liability arising from intent or gross negligence), and do not affect the refund commitments in Article 9.

VI. Beneficiaries of the limitation: the limitations and exclusions of liability in this Article also benefit the Company's responsible person, employees, agents, contractors and processors. You agree not to claim from those persons, for the same facts, compensation exceeding the cap in this Article.

11. Viruses, backdoors and malware

Removing viruses, backdoors and malware is not part of the Service. What the Service repairs is the website's fault.

If your website has been compromised, the Service can still take on the fault repair; but after the repair is complete, unless you remove the malware yourself and strengthen your protection, the website may be damaged again, and that situation is outside the Service's repair guarantee and refund scope.

The Company has no obligation to remove viruses, backdoors or malware merely because they exist on your website, and is not responsible for their persistence, recurrence or any damage they cause.

If the system finds program files in your website that cause a fault or an obvious malfunction, the Company may move them out of their original location (moved out, not deleted); the original files are kept in the pre-repair backup.

The Company strongly recommends that, after the repair is complete, you separately engage a professional security service for complete malware removal and hardening.

12. Intellectual property

All content of the Service, including but not limited to the system, source code, algorithms, architecture, diagnostic methods, report formats, website structure, web design, trade marks and domain names, is the intellectual property of the Company or its rights holders under the law. Without the written consent of the Company or the rights holder, you may not use, modify, reproduce, publicly transmit, adapt, distribute or publish the programs or content of the Service.

You may freely use, keep and pass to third parties you engage the health check report, repair report and Data Access Certificate delivered to you, for your own purposes, but may not reproduce or distribute them commercially or remove their source markings.

Your website's content and data and the intellectual property in them belong to you or your licensors; the Company acquires no rights in them by providing the Service.

13. Confidentiality

The Company owes a duty of confidentiality in respect of your website content, data and technical information that it learns of through providing the Service, and will not disclose it externally save for the purposes set out in these Terms, as required by law, or at the request of a competent authority.

You owe a duty of confidentiality in respect of how the Service's systems operate and its non-public technical information. This obligation continues after these Terms end or the case is closed.

14. Your duty to cooperate and prohibited conduct

You must provide accurate and complete information and working credentials. The Company is not responsible for delay or non-performance caused by inaccurate information or invalid credentials you provided.

When using the Service you may not do any of the following; if the Company determines that you have done so, it may suspend, refuse or terminate the Service, and you shall bear all related legal liability: supplying a website or credentials that are not yours or that you are not authorized to use; using the Service with forged or false information; using the Service to gain unauthorized access to a third party's systems; interfering with, damaging or attempting to circumvent the Service's systems, risk-control mechanisms or billing mechanisms in any way; using the Service for a website that breaches the laws of the Republic of China or public order and morals; reverse engineering, scraping, making large volumes of automated requests to, or otherwise affecting the stability of, the Service.

If the conduct above causes loss to the Company or a third party, you are liable for compensation.

15. Electronic documents as the means of expression

You agree to use electronic documents as the means of expression. Electronic documents exchanged under these terms, where their content can be fully presented and later retrieved for inspection, have the same effect as written documents under the Electronic Signatures Act.

Your use of the functions on the Service's website, and whether or not you agree to any document, are recorded and retained by the Company; your acts on the Service's website have legal effect.

If you have any doubt about, or objection to, any part of the Service or these Terms, you should stop using the Service immediately; if you continue to use it, you are deemed to agree to all of it.

16. Suspension, interruption and force majeure

In any of the following cases the Company may suspend or interrupt all or part of the Service, and you may not claim damages or compensation on that account: when the software or hardware relating to the Service is being relocated, replaced, upgraded, maintained or repaired; where you are in breach of the law or these Terms; because of the act of a third party or another cause not attributable to the Company; natural disaster, war, strike, interruption of the host provider or a third-party service, government action, network or power interruption, a large-scale network attack, or another force majeure event beyond the Company's reasonable control.

If the Service suffers error, delay, interruption or failure to transmit because of a fault in the Company's software or hardware, the Company shall remove the fault and restore the Service as soon as possible; except where the Company is guilty of intent or gross negligence, however, it is not liable in damages. Where such a cause prevents your case from being completed, it is handled under the refund provisions of Article 9.

17. Cookies and local storage

The Service uses no analytics or advertising cookies. Customer-facing pages keep only the functional data that is necessary in the browser's local storage: the case token, the consent receipt, the language preference, and your choice on the cookie banner. That data is used only to provide the corresponding function and not for any cross-site tracking or behavioral analysis. The provider of encrypted transmission and security protection for website connections listed in Article 6 may, when it detects abnormal traffic, set in your browser the cookies necessary for it to perform that security protection. If analytics tools are introduced in future, these Terms will be revised accordingly and your consent obtained afresh, and the analytics tools will load only after you have consented.

18. Amendment and termination

When these terms are amended, the Company will publish the full amended text, its version and its effective date on the Service website.

An amended version applies only to cases created after it; the version you agreed to applies to the whole of your case and is retained by the Company for retrieval and comparison.

You may stop using the Service at any time. Cases already formed are handled under the version applicable when that case was formed.

19. Governing law, dispute resolution and complaints channel

If any provision of these Terms is held to be invalid or unenforceable, that does not affect the validity of the remaining provisions.

These terms are interpreted and applied under the laws of the Republic of China (Taiwan). Where a dispute arising from the Service goes to court, unless the law provides otherwise, the Taiwan Taoyuan District Court is the court of first instance; where the law prescribes exclusive jurisdiction, that applies. If you use the Service as a consumer, this choice of law and forum does not deprive you of the rights and remedies that you enjoy under Article 47 of the Consumer Protection Act, the Code of Civil Procedure and the mandatory consumer-protection law of your place of residence and that cannot be excluded by contract, including the right to bring proceedings where you live.

Complaints: for any question, dispute or complaint, please write to support@wp119.com; the Company will reply within three business days. This is the Service's official contact and complaint channel.

Order of dispute handling: both parties agree to first seek negotiation through the complaint channel above; if that fails, either party may apply for mediation under the Consumer Protection Act or the Township Mediation Act, seeking resolution by mediation before litigation. This is a good-faith commitment by both parties and does not deprive you of any right or remedy you have by law.

You represent that you are of legal age and authorized to agree to this document on behalf of the site owner.
